Law360, New York (February 13, 2017, 6:41 PM EST) — An Illinois federal judge on Monday dismissed a putative class action claiming CVS Pharmacy was selling vitamin C drops falsely labeled as made in the U.S., saying the consumer failed to show he had been harmed.
U.S. District Judge John W. Darrah dismissed David deMedicis’ complaint without prejudice, saying he had failed to show CVS’ alleged deceptive labeling had caused him to spend extra money on vitamins now or would do so in the future.
